U.S. Joins Whistleblower Lawsuit Against California Community Clinic

The Department of Justice announced that the United States has partially intervened in a qui tam action pending in the Northern District of California. The lawsuit brought under the qui tam provisions of the False Claims act is captioned Trinh v North East Medical Services, Inc.

North East Medical Services, Inc. (“NEMS”) is a community clinic that is federally certified and state licensed to provide medical care to economically disadvantaged communities. As this type of healthcare provider, NEMS is entitled to receive payments from the state Medicaid program that exceed the Medicaid amounts typically paid to providers.

In order to qualify for the additional payments, NEMS must submit annual reports to the California Medicaid program reflecting the total amounts it received from all sources for treating Medicaid patients. That amount is then deducted from the total amount of the Medicaid payment NEMS would be entitled to, and NEMS receives the difference.

The government and whistleblower allege that NEMS under-reported the amounts it received from other sources for treating Medicaid patients. The whistleblower’s complaint contains additional allegations against NEMS, but the government has only intervened with regard to the under-reporting of income claim.
