$12.5 Million Qui Tam Settlement

McCabe Rabin, P.A. announces the settlement of United States ex rel. Matthew Moore v. 21st Century Oncology, LLC, Case No. 2:16-CV-99, filed in the United States District Court for the Middle District of Florida.

The firm filed the case in 2016 on behalf of whistleblower client Matthew Moore.  The Defendant, 21st Century Oncology, LLC, is a nationwide healthcare company that offers integrated care and treatment for cancer patients.  As part of its business, 21st Century employs physicians across the country who specialize in oncology.

The whistleblower suit alleged that 21st Century violated the Stark Law, which is a federal law that prohibits healthcare providers from billing Medicare for certain types of health services referred by doctors who have improper financial relationships with the billing entity.  In particular, the lawsuit alleged that 21 Century violated the Stark Law by paying physicians based on the volume or value of their referrals of certain services back to 21st Century.  The goal of the Stark Law is to ensure that patient referrals are made solely in the best interest of the patient and not due to improper financial incentives on the part of the doctor.

The Government investigated Mr. Moore’s allegation, chose to intervene in the suit, and reached a settlement with 21st Century.  Under the terms of the settlement, 21st Century will pay $12.5 million to the United States to resolve Mr. Moore’s allegations.  As a whistleblower reward, Mr. Moore will receive $2 million of the proceeds.

In addition to the civil settlement, 21 Century has agreed to enter into a five-year Corporate Integrity Agreement with the Government.
