Hospital Pays $8.9 Million to Settle Whistleblower Suit

Overlook Hospital (“Overlook”) and its owners and operators, AHS Hospital Corp. and Atlantic Health System, Inc., have jointly agreed to settle a False Claims Act case for $8.9 million. The lawsuit was brought under the qui tam provisions of the False Claims Act by two former Overlook employees. A qui tam action is a whistleblower lawsuit brought by an individual as a “relator” on behalf of the federal government.

The whistleblowers alleged that, from January 2002 to July 2009, Overlook submitted false claims to Medicare. Specifically, the whistleblowers alleged that Overlook billed Medicare for patients treated on an inpatient basis, when they should have been treated as less costly outpatients or as observation patients.

Under the qui tam provisions, the whistleblowers are entitled to share in a percentage of the settlement amount.
