What is the Compensation Available to a Relator in a Qui Tam Action?

The major remedies available to a relator under the False Claims Act are as follows:

  • Triple damages and civil fines of $5,000 to $10,000 per false claim;
  • Payment of the relator’s attorney's fees; and
  • Relator protections, including reinstatement with seniority status, special damages, and double back–pay.

The False Claims Act further provides financial incentives to relators by awarding them between 15% and 30% of any judgment or settlement. If the Government intervenes in the action, the relator is entitled to between 15% and 25% of the recovery. If the Government does not intervene, the relator is entitled to between 25% and 30% of the recovery.

Notwithstanding the increased relator–fee range when the Government does not intervene, the relator typically wants the Government to intervene because its investigative resources, institutional expertise, access to claims information from other agencies, and leverage to encourage settlement usually exceed that of a relator.
